In the new IT Rules 2021 case, the Delhi High Court has issued a notice to the Central Government on the petitions lodged by WhatsApp and Facebook. The petition states that the “traceability” clause under IT Rules 2021 is unconstitutional as it violates the right to privacy of an individual. Under the new IT rules, social media platforms are required to trace messages and identify the source of information. Earlier, newspaper publishers had filed petitions in many courts against the IT Rules 2021. While hearing those petitions, the Bombay High Court had stayed Sections 9(1) and 9(3) of the IT Rules, 2021 for Digital Media, relating to the compliance of the Code of Conduct.
